The White House says the measure is aimed at protecting critical infrastructure from sabotage, unauthorised access and disruption, and it gives the Energy secretary authority to place conditions on equipment already in service.
For operators building large AI facilities, the timing is significant. Transformers, inverters, control systems, batteries and other high-voltage components already face long lead times, strained supply chains and rising procurement risk. By extending federal scrutiny to equipment origin, software and remote-access capabilities, the order could affect not only what can be bought, but also when projects can be energised.
According to the White House, the order covers the purchase, importation, transfer and installation of certain foreign-produced bulk-power equipment, while excluding local distribution facilities. It also reaches associated critical software and digital capabilities. The Energy Department has 120 days to identify the equipment and suppliers that fall within the scope of the rule and to publish implementation measures.
The practical impact may depend on how broadly officials define a security risk. Neil Osnato of Persistence Analytics Group said the main change is that origin, vendor control, software access and lifecycle dependencies may now be treated as part of a reliability judgement rather than a simple procurement check. In his view, operators will have to assess not just whether a component works, but whether it can be relied upon over time.
The North American Electric Reliability Corp. said supply-chain security is an evolving issue for grid reliability and security, and told Data Center Knowledge that it is working with federal agencies and industry as the order is implemented. Jefferies, in an August 27 research note, said the measure lands in an equipment market already under pressure from AI-driven demand and may contribute to longer lead times and higher domestic prices, although the brokerage said the final effect will depend on the rules still to come.
For data centre builders, that leaves a familiar problem unresolved: electricity infrastructure is becoming a gating factor for new capacity, and the equipment needed to connect projects to the grid is now part of the policy risk. Even where generation and transmission are available, delays in sourcing or replacing a transformer or related control system can push back commissioning dates. Osnato said the evidence standard needs to be set earlier in the process so projects do not reach construction only to discover that a critical assumption cannot be trusted.
